Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Ultimate Car Hub (“Ultimate Car Hub,” “we,” “us,” or “our”) and the websites, applications, and services we provide (collectively, the “Platform”). By using the Platform, you agree to these Terms and our Privacy Policy.

1. What Ultimate Car Hub Is

Ultimate Car Hub is an online marketplace that helps buyers discover vehicles and helps sellers publish listings, receive messages, and use tools such as offers, auctions, and Buy Now where enabled. We are a platform provider, not a vehicle dealer, broker, or escrow agent. Unless explicitly stated otherwise, we do not take title to vehicles, inspect vehicles, guarantee condition, or complete purchase transactions between users.

Vehicle purchase price, payment method, title transfer, registration, and delivery are arranged directly between buyers and sellers after they connect through the Platform.

2. Eligibility and Accounts

  • You must be at least 18 years old and able to form a binding contract.
  • You are responsible for keeping your login credentials confidential and for all activity under your account.
  • Registration information must be accurate and kept up to date.
  • We may suspend or terminate accounts that violate these Terms or pose security or legal risk.

Some users are invited to join through email invitations. Invitation links expire and may be used only as directed.

3. Listings and Seller Obligations

Sellers who publish listings also agree to our Listing Agreement. In summary, you must provide truthful, complete listing information; own the vehicle or have authority to sell it; comply with applicable laws; and honor commitments made through offers, auctions, or Buy Now where you accept them.

4. Platform Fees and Payments

  • Listing publication fees. A fee may be required before a listing goes live. The exact amount is shown during the listing payment step before you confirm.
  • Authorization holds. For certain auction or purchase flows, we or our payment partners may place temporary authorization holds on a payment method. Holds are not final charges unless the applicable transaction completes under the feature rules.
  • No vehicle escrow. Platform payments cover marketplace services described at checkout — not the full purchase price of a vehicle between private parties.

Fees are generally non-refundable once a paid service has been delivered, except where required by law or explicitly stated otherwise.

5. Offers, Buy Now, and Auctions

Where available:

  • Offers. Buyers may submit offers subject to seller acceptance. Sellers may accept, reject, or allow offers to expire according to Platform rules.
  • Buy Now. Fixed-price purchase options, where offered, are subject to availability and seller confirmation workflows shown at the time of use.
  • Auctions. Bidding rules, reserve prices, anti-sniping extensions, and winner selection follow the auction settings displayed for each listing. Bidders must have a valid payment method on file where required. Winning bidders and sellers remain responsible for completing the off-platform vehicle transaction.

6. Messaging

In-app messaging is provided for buyer–seller communication related to listings. Do not use messaging for harassment, spam, fraud, or sharing unlawful content. You choose when to share phone numbers or other contact details outside the Platform.

7. Acceptable Use

You agree not to:

  • Post false, misleading, or stolen-vehicle listings
  • Circumvent fees, scrape the Platform, or reverse engineer our services
  • Interfere with auctions, offers, or other users’ transactions
  • Upload malware or content that infringes intellectual property or privacy rights
  • Use the Platform for unlawful discrimination or prohibited commercial activity
  • Impersonate another person or misrepresent your affiliation with a business

8. AI and Voice Features

AI-assisted search, voice input, and listing tools are provided for convenience. Outputs may be inaccurate or incomplete. You are responsible for reviewing and confirming all listing details, search filters, and pricing before relying on them.

9. Intellectual Property

The Platform, including its design, software, and branding, is owned by Ultimate Car Hub or its licensors. You retain ownership of content you submit but grant us a non-exclusive license to host, display, and distribute listing content on the Platform and in promotional materials reasonably related to operating the marketplace.

10. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT LISTINGS ARE ACCURATE, THAT VEHICLES ARE FREE OF DEFECTS, OR THAT TRANSACTIONS BETWEEN USERS WILL SUCCEED.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ULTIMATE CAR HUB AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTION BETWEEN USERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID TO US FOR PLATFORM SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Ultimate Car Hub from claims arising out of your listings, your conduct on the Platform, your violation of these Terms, or your violation of any law or third-party rights.

13. Dispute Resolution

Before filing a formal claim, contact support@ultimatecarhub.com and allow a reasonable opportunity to resolve the issue informally. These Terms are governed by the laws of the jurisdiction where Ultimate Car Hub is organized, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence apply.

14. Changes and Termination

We may modify these Terms or discontinue features at any time. Continued use after changes become effective constitutes acceptance. You may stop using the Platform at any time. We may suspend or terminate access for violations or risk to users or the Platform.
