Listing Agreement

This Listing Agreement (“Agreement”) applies when you create, edit, publish, or maintain a vehicle listing on Ultimate Car Hub (“Ultimate Car Hub,” “we,” “us,” or “our”). It supplements our Terms of Service and Privacy Policy. By publishing a listing or paying a publication fee, you agree to this Agreement.
1. Seller Representations
By listing a vehicle, you represent and warrant that:
- You are at least 18 years old and legally permitted to sell the vehicle in your jurisdiction
- You own the vehicle or have written authority from the owner to sell it
- The vehicle is not stolen and is free of undisclosed liens or encumbrances that would prevent transfer, except as clearly disclosed in the listing
- All information you provide — including price, mileage, VIN, title status, accident history, and condition — is truthful and not misleading
- Photos and media depict the actual vehicle offered for sale and are not substantially altered to conceal material defects
2. Listing Content and Standards
You agree to:
- Complete required fields accurately before publishing, including vehicle identifiers where requested
- Upload a sufficient number of clear photos that show the vehicle’s exterior, interior, and any known damage
- Set a legitimate asking price, reserve, or auction terms consistent with your intent to sell
- Promptly update or remove the listing if the vehicle is sold elsewhere, is no longer available, or material facts change
- Respond to buyer messages in a reasonable and professional manner
We may reject, unpublish, or remove listings that violate this Agreement, our Terms of Service, applicable law, or marketplace quality standards.
3. Publication Fees
Going live on the marketplace may require payment of a listing publication fee. The fee amount is displayed during the payment step before you confirm. Payment of the publication fee grants you access to the publishing services described at checkout for that listing; it does not guarantee a sale.
Publication fees are charged for platform services and are generally non-refundable once the listing has been published, except where required by law or where we explicitly provide a refund policy for a specific promotion or error on our part.
4. Listing Lifecycle
Listings may move through statuses such as draft, pending payment, active, sold, expired, or removed. You may:
- Save drafts and return to complete them later
- Edit active listings where the Platform allows, subject to audit and buyer-notification rules
- Mark a vehicle as sold or remove a listing when it is no longer available
We may expire or archive listings that remain inactive for extended periods or that no longer meet marketplace requirements.
5. Offers, Buy Now, and Auctions
If you enable transactional features for a listing:
- Offers. You may accept or reject buyer offers according to Platform rules. Accepting an offer creates a commitment to proceed in good faith toward completing the sale on terms communicated through the Platform.
- Buy Now. Where offered, you must honor a completed Buy Now flow unless the listing clearly states otherwise or a Platform error occurred.
- Auctions. You are responsible for setting accurate start time, duration, reserve, and bidding rules shown to buyers. If a valid winning bid meets your stated reserve and auction rules, you agree to sell to the winning bidder in good faith. Anti-sniping extensions may apply automatically near the scheduled end time.
Ultimate Car Hub facilitates discovery and communication tools. Title transfer, payment for the vehicle itself, inspection, and delivery remain your responsibility with the buyer.
6. Contact Information and Privacy
You control certain visibility settings, such as whether your phone number appears on a listing. Do not publish another person’s personal information without permission. Buyer and seller messages sent through the Platform are stored as described in our Privacy Policy.
7. Prohibited Listings
You may not list:
- Vehicles you do not have the right to sell
- Salvage or unsafe vehicles without clear disclosure where required by law
- Duplicate or spam listings for the same vehicle
- Vehicles primarily intended for unlawful use or in violation of import/export rules
- Non-vehicle items, deceptive placeholders, or bait-and-switch advertisements
8. AI-Assisted Listing Tools
If you use voice input or AI listing assistance, you remain solely responsible for reviewing and correcting all extracted fields before publishing. AI suggestions may be incomplete or incorrect; they do not replace your duty to provide accurate listing information.
9. License to Display Your Listing
You grant Ultimate Car Hub a worldwide, non-exclusive, royalty-free license to host, reproduce, publicly display, and distribute your listing content (including photos and descriptions) on the Platform and in reasonable marketing related to operating the marketplace. You retain ownership of your content.
10. Indemnification
You agree to indemnify and hold harmless Ultimate Car Hub from claims, losses, and expenses (including reasonable legal fees) arising from your listing, the sale or attempted sale of the vehicle, misrepresentations you make, or your violation of this Agreement or applicable law.
11. Removal and Account Action
We may remove listings, restrict selling privileges, or suspend accounts for repeated violations, fraud reports, chargeback abuse, or conduct that harms buyers or the marketplace. Removal of a listing does not automatically entitle you to a refund of publication fees unless required by law.
12. Changes
We may update this Agreement from time to time. Material changes will be reflected by the “Last updated” date. Continued use of listing features after changes become effective constitutes acceptance.
